Apto Solutions - Asset Recovery Compliance
Apto Solutions maintains a comprehensive Compliance Program to address common industry concerns such as data security, protecting the environment, and complying with laws surrounding the export of commercial goods. Company-wide policies and procedures have been implemented to ensure adherence to government regulations, and safeguards such as staff training and internal auditing are also in place. All aspects of our Compliance Program are overseen by Apto’s Compliance Officer.
Environmental Compliance
The Bureau of Industry and Security regulates the export of dual-use commercial items, including IT and telecommunications equipment. Government regulations place restrictions upon the type of equipment that may be exported, the shipping destinations, and the end-uses and end-users of such equipment. Apto ’s “ Know Your Customer” procedures address each area of concern, assuring total compliance with the multitude of regulations pertaining to overseas asset sales.
Export Compliance
The Bureau of Industry and Security regulates the export of dual-use commercial items, including IT assets. The Export Administration Regulations place restrictions upon the type of equipment that may be exported, the destinations, as well as the end-uses and end-users of that equipment. In addition, the Office of Foreign Assets Control limits the export of commercial goods to particular countries, persons and business entities. Apto ’s compliance program addresses these issues through our Know Your Customer procedures, including our internal customer record, which is required for each new customer we transact business with. Our Compliance Program assures total compliance with the multitude of regulations pertaining to overseas asset sales.
Data Security
Small and large corporations must ensure complete removal of hard drive data to comply with Acts such as Gramm-Leach Bliley and HIPAA. Additionally, every business ’s own internal records and practices, as well as employee records, must be kept confidential. Apto offers Department of Defense 5220.22-M standard data wipes, and additional wipes are performed upon request by our clients. Systems data will never be accessed by third parties.
Electronic Tracking
Our back-end system electronically stores each asset inventoried to the serial number level. The captured data is maintained, and each client is offered secure access to track its assets. Asset purchaser information, sales numbers, data destruction records, and more are all part of our automated system. The capability to electronically track your business ’s surplus assets will eliminate any question that they were handled in a fully compliant manner.
Non-Compliance Puts Your Business at Risk
The Risks: Improper asset disposition may expose your organization to the following harmful consequences:
- Regulatory fines
- Criminal or civil charges
- Heightened scrutiny by law enforcement agencies
- Bad publicity and potential loss of market share
Without proper management, a business’s surplus assets might end up in a landfill, or in the hands of an individual or organization overseas that is subject to U.S. embargo. Data that your organization intended to destroy might be retrieved by criminals and used for illegal scams or identity theft. Fortune 500 companies have paid hundreds of thousands of dollars in regulatory fines for disposing of surplus and end-of-life assets in non-compliant manners.
